General Terms and Conditions of Contracting

These General Terms and Conditions of Contracting govern the contractual relationships between the user (hereinafter, “the Customer”) and Luzgurú (hereinafter, “the Company”), represented by Álvaro Pecino Martínez, for purchases made through the website www.luzguru.com (hereinafter, “the Site”).
By placing an order on the Site, the Customer accepts these Terms and Conditions of Contracting. It is essential to read and understand them before completing a purchase.

2. Purpose of the Contract
These terms govern the sale of products offered on the Site to registered or guest users who wish to purchase them. Information about products, prices, and conditions is detailed in each item’s description.
3. Purchase Process
- Product Selection: The Customer can select products and add them to the cart.
- Order Placement: To complete the purchase, the Customer must fill in shipping and billing details and accept the purchase terms.
- Order Confirmation: After payment, a purchase confirmation will be sent to the Customer by email.
- Payment: Accepted payment methods include credit/debit cards and other available methods on the Site. Payment must be completed for the order to be valid.
4. Right of Withdrawal
The Customer has the right to withdraw from the purchase without justification within 14 calendar days of receiving the product. To exercise this right, the Customer must notify the Company in writing (email: devoluciones@luzguru.com) within the specified period.
Withdrawal Conditions:
- The product must be returned in its original packaging, in perfect condition, unused, and with all accessories and documentation included.
- Return shipping costs will be borne by the Customer unless otherwise agreed with the Company.
- Once the product is received and verified, the refund will be processed within 14 days of receiving the return.
Exceptions to the Right of Withdrawal:
- Customized or made-to-order products.
- Products that, by their nature, cannot be returned (e.g., opened products unsuitable for return for hygiene reasons).
5. Delivery Times
- Delivery Time: The estimated delivery time is 2-4 business days from order confirmation. Depending on the supplier, delivery may take up to 15 days. If the Customer wishes to know the approximate date, they can contact us at info@luzguru.com.
- Delivery Delays: In case of delivery delays, the Company will inform the Customer and provide a new estimated date. The Customer has the right to cancel the order if the delay exceeds 20 days without justified cause.
6. Returns and Refund Policy
Exchanges: Exchanges are accepted only for products of equal or higher value within 14 days of receiving the product, provided it is in its original, unused condition. The Customer must cover shipping costs for returning the original product and sending the new one, unless the exchange is due to a shipping error or product defect caused by the Company.
Refunds:
- If the Customer requests a refund due to withdrawal, the total product amount (minus return shipping costs) will be refunded within 14 days of receiving and verifying the product.
- If the refund is due to a product defect or Company error, all costs, including return shipping, will be refunded as long as the return is authorized and arranged with the Company’s selected courier.
7. Product Warranty
Legal Warranty: All products come with a 3-year warranty from the delivery date, as per current legislation. This warranty covers manufacturing, material, and functionality defects.
Warranty Conditions:
- The warranty does not cover damages caused by misuse, negligence, or unauthorized manipulation of the product.
- In case of a defective product, the Customer must contact the Company via email (devoluciones@luzguru.com) to initiate the repair, replacement, or refund process, as appropriate.
Warranty Process:
- The Customer must send an email detailing the defect and attach photos or videos for evaluation.
- The Company will respond within a maximum of 5 business days with instructions on the next steps.
8. Dispute Resolution and Online Dispute Resolution (ODR) Platform
Dispute Resolution Platform: In accordance with Regulation (EU) No 524/2013, we inform users of the existence of a European online dispute resolution platform, which can be used to resolve disputes arising from electronic transactions. Users can access this platform via the following link: https://ec.europa.eu/consumers/odr/.

9. Governing Law and Jurisdiction
These General Terms and Conditions of Contracting are governed by Spanish law. In the event of a dispute, the parties shall submit to the courts of Algeciras, Cádiz, or those applicable under consumer protection regulations.
10. Modification of General Terms
The Company reserves the right to modify these terms at any time. The new terms will be available on the Site and apply to purchases made after their publication.
